Beneficiaries of an estate have the right to information concerning the estate and to receive their inheritance in a timely manner.
The following is a partial list of the rights of beneficiaries:
- the right to be notified when the executor applies to Court for probate (a Certificate of Appointment of Estate Trustee), and to object to the appointment to the proposed executor if he/she disagrees.
- the right to information concerning the assets and ongoing accounting of the estate. If the executor does not produce this information voluntarily, a beneficiary may request the assistance of the Court.
- the right to receive their entitlement under the estate in a timely manner. The length of time will depend on the nature and complexity of the estate.
- the right to review and approve or disapprove of the amount of compensation due to the executor. If the beneficiaries do not agree with the amount of compensation, a Court will determine what is appropriate.
- if a beneficiary is dissatisfied with the efforts made by the executor, the beneficiary can apply to the Court for an order removing the executor.
